Welcome to Oh My Crafty Supplies. These Terms of Service (“Terms”) govern your access to and use of our website, products, digital embroidery files, digital designs, downloads, content, services, and any related features offered by Oh My Crafty Supplies (“Oh My Crafty,” “we,” “us,” or “our”).

By visiting our website, creating an account, placing an order, downloading a file, purchasing a product, or using any part of our website or services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or purchase from us.

1. Overview of Our Products and Services

Oh My Crafty Supplies offers embroidery-related products, including but not limited to digital embroidery designs, downloadable embroidery files, sewing and embroidery supplies, physical products, educational materials, and related creative content.

Some products are delivered digitally, while others may be shipped physically. Additional policies, product descriptions, license terms, or usage instructions may appear on individual product pages. Those additional terms are incorporated into these Terms by reference.

2. Digital Embroidery Designs Are Licensed, Not Sold

All digital embroidery files, designs, artwork, images, graphics, stitch files, previews, product images, instructions, written materials, downloads, and related creative assets sold or provided by Oh My Crafty Supplies are licensed, not sold.

When you purchase, download, or otherwise receive a digital embroidery design from us, you are receiving a limited license to use that design under the terms stated here. You do not receive ownership of the design, artwork, file, image, copyright, trademark, intellectual property, or any underlying creative rights.

Oh My Crafty Supplies and/or its licensors, designers, artists, or content providers retain all rights, title, and interest in and to all digital designs, images, artwork, embroidery files, product previews, instructions, written content, and related materials.

Your purchase gives you permission to use the design only in the ways allowed by these Terms.

3. License Granted to Customers

Subject to your compliance with these Terms, Oh My Crafty Supplies grants you a limited, non-exclusive, non-transferable, revocable license to download and use purchased digital embroidery files for personal crafting, embroidery projects, and the creation of finished physical items.

Unless otherwise stated on a product page, you may use purchased embroidery designs to stitch finished physical items for personal use, gifts, or small business resale of finished stitched goods.

This license does not allow you to sell, share, transfer, copy, upload, distribute, modify for redistribution, or otherwise make available the digital embroidery file or design itself.

4. Ownership and Intellectual Property Rights

All digital embroidery files and designs remain the intellectual property of Oh My Crafty Supplies and/or the original rights holder. This includes, but is not limited to:

Embroidery stitch files;
Digitized designs;
Design previews and product images;
Artwork and illustrations;
Pattern files;
Instruction files;
Downloadable PDFs;
Website images and graphics;
Product descriptions and written materials;
Logos, branding, and trademarks;
Any modified, converted, resized, recolored, or edited versions of our files or designs.

Purchasing or downloading a file does not transfer ownership, copyright, authorship, or intellectual property rights to you.

You may not claim any Oh My Crafty Supplies design, file, artwork, or image as your own creation. You may not register, trademark, copyright, or otherwise attempt to claim rights in any design, file, or artwork obtained from us.

5. Permitted Uses of Digital Embroidery Files

Unless a product page states otherwise, you may:

Download the purchased file for your own use.
Save backup copies for your own personal file storage.
Use the design to create finished physical embroidered items.
Sell finished physical embroidered items made by you or your business, provided the digital file itself is not sold, shared, transferred, or distributed.
Resize or adjust a design for your own stitching purposes, at your own risk.
Use photos of finished stitched items for your own marketing, provided you do not imply ownership of the original digital design.

6. Prohibited Uses of Digital Embroidery Files

You may not do any of the following:

Sell, resell, share, trade, gift, give away, upload, transfer, distribute, or otherwise provide any digital embroidery file or design to another person or business.
Upload our designs or files to Facebook groups, file sharing websites, cloud folders, marketplaces, forums, social media groups, or any public or private file-sharing location.
Include our files in bundles, collections, subscription libraries, memberships, design packs, resale packages, or digital download clubs.
Convert our files into another format and sell, share, distribute, or claim the converted version as your own.
Alter, edit, recolor, resize, redigitize, trace, recreate, or modify our files or artwork for the purpose of resale, redistribution, or claiming ownership.
Use our product images, mockups, design previews, screenshots, or website photos to sell competing digital designs or to imply that you created the design.
Use our files or artwork to create transfers, SVGs, clipart, printables, sublimation files, laser files, cut files, patches for resale as standalone design assets, or other digital products unless we give written permission.
Use our designs in any way that is unlawful, misleading, defamatory, obscene, abusive, infringing, or harmful.
Share login credentials or allow others to access your account for the purpose of downloading files.
Use automated bots, scraping tools, download managers, or other systems to copy, harvest, or bulk-download website content in a way that harms or abuses our website.

Violation of this section may result in termination of your account, cancellation of download access, refusal of future service, and/or legal action.

7. Customer Responsibility to Save and Maintain Files

It is the customer’s sole responsibility to download, save, organize, back up, and maintain all purchased digital files.

Oh My Crafty Supplies may provide customer account access, download links, order histories, or file libraries as a convenience. However, we do not guarantee that digital files, download links, customer accounts, old purchases, archived orders, or downloadable content will remain available forever.

You are responsible for keeping your own backup copies of purchased files after download. We are not responsible for files lost due to computer failure, accidental deletion, account issues, forgotten login credentials, software problems, device changes, discontinued products, website updates, server migrations, expired download links, or any other cause outside our direct control.

If you lose access to a file, we may attempt to help when possible, but we are not obligated to replace, resend, restore, or recreate lost files indefinitely.

8. Download Access and Account Access

Digital products may be delivered through account downloads, order confirmation pages, email links, or other delivery methods selected by Oh My Crafty Supplies.

We may limit, suspend, modify, or remove download access if:

We believe an account is being abused;
Files are being shared or distributed improperly;
Fraud, chargebacks, or payment issues occur;
A product is discontinued;
A file is replaced, updated, or removed;
Website maintenance, security updates, or technical changes require it;
Continued access is no longer commercially or technically practical.

We may also update, replace, rename, reorganize, or remove files from our website at any time.

Customers should download and back up all purchased files promptly after purchase.

9. Embroidery Machine Compatibility and File Formats

Digital embroidery files may be offered in one or more embroidery machine formats. It is your responsibility to confirm that your machine, software, hoop size, thread choice, stabilizer, fabric, and equipment are compatible with the file before purchase and before stitching.

We make reasonable efforts to provide accurate product information, including format details, design sizes, stitch counts, and hoop requirements when available. However, we do not guarantee that every design will work with every machine, software program, fabric, stabilizer, thread, hoop, or user setup.

You are responsible for knowing how to transfer, open, read, stitch, and use embroidery files with your own equipment.

10. Test Stitching and Results

Embroidery results can vary depending on machine type, fabric, stabilizer, thread, hooping method, tension settings, needle condition, software settings, resizing, and user experience.

We recommend test stitching designs before using them on final garments, expensive blanks, customer items, or finished products.

Oh My Crafty Supplies is not responsible for damaged garments, ruined blanks, wasted thread, wasted stabilizer, machine issues, poor stitching results, puckering, thread breaks, alignment issues, resizing problems, color differences, or other project results caused by customer equipment, materials, settings, or use.

11. Resizing, Editing, and Conversions

Customers may resize, edit, or convert embroidery files for their own personal stitching needs, but doing so is at the customer’s own risk.

Changing the size, density, format, stitch settings, or structure of a design may affect stitch quality and may cause poor results. We are not responsible for issues that occur after a customer edits, resizes, converts, or modifies a file.

Modified files remain subject to these Terms and may not be sold, shared, transferred, or distributed.

12. Digital Product Refund Policy

Due to the nature of digital embroidery files and instant downloadable products, all digital product sales are generally final once the file has been delivered, downloaded, accessed, or made available.

We do not offer refunds simply because:

A customer changed their mind;
A customer purchased the wrong item;
A customer does not know how to use their machine or software;
A customer did not confirm file format or hoop size before purchase;
A customer expected a different file type or design size;
A customer no longer wants the design;
A customer lost the downloaded file after purchase;
A customer’s machine, software, or equipment is incompatible;
A design was resized, converted, edited, or otherwise changed by the customer.

At our discretion, we may offer help, replacement downloads, store credit, or a refund in limited situations, such as duplicate purchases, verified file defects, or technical delivery errors caused by our system.

Any refund, credit, replacement, or exception offered by us does not waive our right to enforce these Terms in the future.

13. Physical Product Orders

For physical products, product availability, pricing, shipping time, and delivery estimates may vary. Product descriptions, photos, colors, weights, dimensions, and availability are provided as accurately as possible, but we do not guarantee that all information will be error-free.

We reserve the right to correct errors, update listings, cancel orders, adjust pricing, limit quantities, or refuse service where necessary.

Shipping delays, carrier delays, supplier delays, backorders, lost packages, weather interruptions, address errors, customs delays, and other issues outside our direct control may affect delivery timelines.

Customers are responsible for providing accurate shipping information at checkout.

14. Backorders, Supplier Inventory, and Delays

Some products may be subject to supplier availability, backorder status, manufacturer delays, or third-party fulfillment timelines.

If an item is backordered, delayed, or unavailable, we may contact you with options, including waiting for restock, substituting an item, canceling the unavailable item, or issuing a refund for that item where appropriate.

Delivery estimates are not guarantees unless expressly stated in writing.

15. Pricing, Payment, and Order Acceptance

All prices are listed in U.S. dollars unless otherwise stated. Prices, discounts, promotions, product availability, and shipping charges may change without notice.

Payment must be received and approved before orders are processed or digital files are made available.

An order confirmation does not guarantee acceptance of an order. We reserve the right to refuse, cancel, limit, or refund any order for reasons including suspected fraud, pricing errors, inventory issues, misuse of our website, violation of these Terms, or other reasonable business concerns.

16. Coupons, Promotions, and Sales

Coupons, discounts, sales, and promotional offers may be limited by date, product type, customer account, order amount, or other conditions. Promotions cannot be applied retroactively unless we choose to allow it.

We may modify, suspend, or cancel promotions at any time.

17. Customer Accounts

Support availability may vary and is not guaranteed at all times.

20. Third-Party Products, Services, and Links

We do not guarantee that any embroidery file will meet your specific needs, work with your specific machine or software, stitch perfectly on your chosen materials, or produce a particular result.

26. Limitation of Liability

To the fullest extent permitted by law, Oh My Crafty Supplies shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, lost files, lost business, damaged materials, ruined blanks, wasted supplies, machine issues, or project losses.

Our total liability for any claim related to a purchase, product, file, service, or website use shall not exceed the amount you paid to Oh My Crafty Supplies for the specific product or order giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

27. Indemnification

You agree to indemnify, defend, and hold harmless Oh My Crafty Supplies, its owners, employees, contractors, designers, suppliers, partners, and affiliates from and against any claims, damages, losses, liabilities, expenses, or fees arising from:

28. Chargebacks and Payment Disputes

We reserve the right to suspend account access, download access, future purchases, and licenses associated with orders involved in fraudulent, abusive, or improper chargebacks or payment disputes.

Filing a chargeback after receiving or downloading digital files does not grant permission to keep, use, share, or distribute those files if the order is reversed, refunded, canceled, or disputed.

29. Changes to These Terms

We may update or modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date.

Your continued use of our website, account, products, downloads, or services after changes are posted means you accept the updated Terms.

30. Severability
